1. Interaction with the user

ReciClan allows Users to interact through the application, providing features aimed at managing and taking part in the services offered, according to the access profile (Public Administrations, family administrators and members of family clans).

1.1 The User acknowledges and accepts that

a) Licence of use

  1. This APP grants the User a non-exclusive, limited, non-transferable and revocable licence to use the service, which must be used exclusively for the purposes of the application and in accordance with current regulations, in particular Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).
  2. In the case of Public Administrations, use of the application must be in line with their powers and institutional purposes and, where applicable, the principles and requirements established in the Spanish National Security Framework (ENS).
  3. In the case of family clans, the administrator user is responsible for the proper management of the group, including the addition of members and, where applicable, minors, ensuring that they have the necessary authorisation and supervising appropriate use.

RECICLAN APP, S.L. reserves all rights not expressly granted in these Terms and Conditions of Use and may suspend or revoke the licence of use at any time in the event of breach, misuse or use contrary to applicable regulations.

b) Liability for third-party content

RECICLAN APP, S.L. is not responsible for the content of third-party advertising, nor for the content, services or materials available on external websites linked from the application, in accordance with Articles 16 and 17 of the LSSI-CE. Access to such content is the sole responsibility of the User.

c) Limitation of liability

RECICLAN APP, S.L. shall not be liable for damages of any kind that may arise from use of the application, including, by way of example and without limitation, errors or omissions in the content, unavailability of the service, interruptions, technical failures, viruses or malicious software, provided they are not directly attributable to it.

Likewise, RECICLAN APP, S.L. shall not be liable for indirect damages, loss of profit or loss of data that may arise from the User's use of the application.

d) Appropriate use and supervision

The User undertakes to make appropriate use of the application, in accordance with current regulations, good faith and public order. In the case of users belonging to family clans, the administrator is responsible for supervising the members' use of the application, especially in the case of minors.

1.2 Obligations of Users

a) Conditions of access and use

Access to and use of the APP and/or the Services is subject to compliance with the technical, legal and usage requirements set out in these Terms and Conditions. The User undertakes to use the application diligently, in accordance with current regulations, good faith and public order.

b) Technical requirements and connectivity

Access to ReciClan and/or its Services may require the device to be connected to the Internet, as well as the use of services provided by third parties (telecommunications operators, Internet service providers, etc.). RECICLAN APP, S.L. does not guarantee the continuous availability of the service where it depends on such third parties.

c) Responsibility for third-party services

The User undertakes to comply with the terms and conditions of the third parties whose services are necessary to use the APP. The User is also responsible for checking that the installation and use of the application do not exceed data consumption limits, tariffs or other applicable restrictions, releasing RECICLAN APP, S.L. from any liability arising from such consumption or limitations.

d) Security of the device and of information

The User is responsible for keeping their device secure, taking the necessary measures to prevent unauthorised access, such as using strong passwords, lock systems, keeping the operating system and applications up to date, and installing security solutions where advisable.

The User also undertakes not to introduce, transmit or distribute through the APP any malicious software (viruses, malware or any other harmful code) that may affect the correct operation of the service or third parties.

e) Management of access credentials

The User is responsible for safeguarding and keeping confidential their access credentials (username, password or other authentication mechanisms) and undertakes not to disclose them to third parties. In the event of suspected misuse or unauthorised access, the User must notify RECICLAN APP, S.L. immediately.

In the case of family clans, the administrator user is responsible for the proper management of members' access, especially in the case of minors.

1.3 The User acknowledges and accepts that they may not

  1. Use, develop or promote the use of unauthorised mechanisms, such as cheats, modifications, exploits or any other means that interfere with, alter or provide an unfair advantage in the use of the APP and/or the Services.
  2. Interfere with, interrupt or attempt to interrupt the normal operation of the APP, its systems or any technological infrastructure managed by RECICLAN APP, S.L.
  3. Attempt to access the APP, its systems, servers or databases, or any restricted information or feature, without authorisation.
  4. Make automated use of the APP, including, among others, the use of bots, scripts or scraping tools, without the express authorisation of RECICLAN APP, S.L.
  5. Impersonate third parties or use false identities when using the APP, including creating accounts on behalf of other people without their consent.
  6. Use the APP to carry out unlawful activities or activities contrary to current regulations, or for purposes that infringe the rights of third parties.

2. Operation

2.1 Scope

ReciClan is available for download in Spain. However, its effective use is subject to the relevant Council having previously registered and enabled the service in the corresponding territorial area.

2.2 Obtaining ReciClan through digital stores

2.2.1 Digital stores

If the APP is obtained through any digital store, the User and ReciClan acknowledge and accept that:

  1. This document is entered into between the User and ReciClan only, and not with the digital stores, the company being solely responsible for the APP and its content.
  2. The digital stores have no obligation whatsoever to provide maintenance and support services in relation to the APP, whether under these terms and conditions of use or any other applicable law.
  3. ReciClan, and not the digital stores, will handle any claims by the User or any third party in relation to the APP, including:
    1. Liability claims for the services offered in the APP.
    2. Any claim in the event that the APP fails to comply with any applicable legal or regulatory requirement.
    3. Claims relating to consumer protection or similar legislation.
    4. In the event of any third-party claim relating to the infringement of intellectual property rights in connection with the APP or its possession or use, ReciClan, and not the digital stores, will be solely responsible for investigating, defending and handling such claim.
    5. The digital stores and/or their subsidiaries will be third-party beneficiaries of this document.
    6. Upon acceptance of this document, the digital stores will have the right to enforce it as third-party beneficiaries.

2.2.2 Downloading ReciClan

ReciClan is a multi-platform application, available through different access environments depending on the version enabled at any given time:

  • Apple Store and Google Play. ReciClan is available for download on the official App Store (Apple) and Google Play Store (Android) platforms, allowing installation on devices compatible with those operating systems. Access to the application is through unique credentials, which allow the features to be managed regardless of the device used.
  • Apple platform (iOS). Where the application is available exclusively for the iOS operating system, it may only be downloaded and installed through the App Store, and a device compatible with that operating system is required.
  • Web platform. ReciClan may be available in a web version, accessible through a browser. In that case, no download is required and the User may access it directly with their credentials from a compatible web environment.

The availability of the application on each platform may vary depending on technical, operational or contractual decisions, and simultaneous access in all environments is not guaranteed.

2.3 Cost of the APP

The ReciClan APP is free to access and use for the User, and there is no cost for downloading, installing or using it.

Likewise, the application does not include payment features or financial transactions, so no data relating to the User's means of payment (such as bank cards or other financial instruments) will be requested or processed.

However, accessing and using the application may involve mobile data consumption or the use of third-party services (such as Internet access or telecommunications providers), the costs of which shall in all cases be borne by the User in accordance with the conditions contracted with those providers.

2.5 Uninstalling

If the User wishes to uninstall the APP, they must uninstall it from their device.

This does not automatically delete the information the APP holds about the User, so if the User wishes RECICLAN APP, S.L. to delete the information it holds, they must submit a request by email to info@reciclan.org or by post to Avinguda d'en Piera 132, 08107 Martorelles (Barcelona), Spain.

2.6 Cancelling the user account

If the user cancels their account, their data will cease to be visible once the cancellation takes effect; however, please note that if the user has posted images and/or comments, these may remain visible to Users of the APP.

User data may be retained in the following cases: to comply with a legal obligation, to meet regulatory requirements, to resolve disputes, to maintain security, to prevent fraud and abuse, to enforce our terms of use, or to comply with the user's cancellation request so as not to receive future messages from us. Once the account is closed, the information will be kept in anonymised form.

3. Support

In accordance with these Terms and Conditions of Use, ReciClan is obliged to offer and/or publish through the digital store new extensions or versions, and other services relating to the use of the APP or the Service.

In any event, RECICLAN APP, S.L. is responsible for updating the APP through the features provided by ReciClan via the digital store.

The User may be informed by push notification of updates to be made to the APP.

4. Third-party services

ReciClan may use third-party services:

  1. To obtain software and/or services (for example, to create a particular component of the APP).
  2. In connection with the Software and/or services (for example, a social networking website).

In addition, in order to obtain, install, update, access, use or continue to access the APP, you may need to use certain third-party services.

ReciClan may obtain analytics data through providers that help understand usage and analyse the popularity of the APP. This analysis is carried out on behalf of ReciClan, so responsibility for that activity lies with the APP itself. In the Cookie policy section the User can find full information on the analytics and the provider(s) used by the APP.

The APP may contain links (including through advertising) to third-party websites or other third-party content or services. These links are provided solely for your convenience and may not be kept up to date. You acknowledge that such links should not be interpreted as an endorsement, approval or recommendation by us of the third parties or of any content or services provided by them, and that the use of any third-party content or services may be subject to Terms and Conditions of Use outside the APP.

5. Warranty

The User accepts that it cannot be guaranteed that the APP and the services arising from it are free of errors; the existence of such errors does not constitute a breach of this document.

Unless expressly stated otherwise in this document, and to the extent permitted by applicable law, ReciClan shall not be liable to the User for any loss, including special, indirect or consequential damages (such as loss of profit), or any claim, arising from a breach of this document or as a result of the defective use of the services offered by RECICLAN APP, S.L.

6. User profiles

RECICLAN APP, S.L. informs users of the profile(s) enabled in the APP, the information required for each profile and any special category information, should it be required.

6.1 User registration

In order to access and use ReciClan's features, the interested party must first register as a User in the application, creating an account that gives access to their private area.

If the User wishes to cancel their registration, they must proceed as set out in sections 2.5 Uninstalling and 2.6 Cancelling the user account.

For registration purposes, the User must select the relevant municipality; being registered as a resident there is an essential requirement in order to make full use of the application's features.

The application allows the User to modify their profile information and settings at any time through their private area.

Once the registration process is complete, the application will provide the User with the necessary access credentials, which are personal and non-transferable and allow access to the application's features and to the private area.

The APP has a password recovery system, available:

  • From the APP itself
  • From the website
  • By email
  • Other

When creating their User profile, the User may personalise it with a photograph, always with their consent. The User may also change that image at any time, always in compliance with section 9. Code of conduct of these Terms and Conditions of Use.

Spanish Organic Law 1/1982 of 5 May on the civil protection of the right to honour, personal and family privacy and one's own image establishes that this right shall be protected under civil law against all kinds of unlawful interference, including "the capture, reproduction or publication by photograph, film or any other process of a person's image in places or at moments of their private life or outside them". The User is therefore informed that content posted in the APP will be protected by intellectual property rights; as regards photographs and videos, the User grants us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide licence to use any content the User posts in the APP, which ends when the User deletes their User profile in the APP, unless the content has been shared with third parties and they have not deleted it.

ReciClan is under no circumstances responsible for the content of the images or their accuracy.

6.2 Family clan registration

In order to use ReciClan's features in "Family Clan" mode, a User must be designated to act as administrator of the clan.

The Family Clan administrator is responsible for creating and managing the clan and has the power to send invitations to other Users so that they can join as members.

The addition of new members is subject to express acceptance of the invitation sent by the administrator; once accepted, those Users become members of the Family Clan with access to the corresponding features.

It is necessary to register as a User in our APP and to access the private area. To cancel your registration, see sections 2.5 Uninstalling and 2.6 Cancelling the user account.

To register you must select the municipality, and only if you are registered as a resident there will you be able to use the application.

6.3 Registration of public administrations and councils

Access to and use of ReciClan by Public Administrations, and in particular by local Councils, requires the prior formalisation of the corresponding legal relationship with the owner of the application, through the signing of the relevant service agreement.

Once that agreement is signed, the owner and administrator of the application will register the Council on the platform, enabling the specific features intended for its management and operation.

Registering the Council involves creating an institutional profile and assigning access credentials to the users designated by the entity itself, who will act in its name and on its behalf.

Each Council is responsible for the accuracy of the data provided for its registration, for the proper management of its authorised internal users and for the use they make of the application in the performance of their duties.

Access to and use of ReciClan by Councils is also subject to the conditions established in the agreement signed, as well as to these terms of use, insofar as applicable.

6.4 User account security

The User is responsible for keeping confidential the username and password chosen during the registration process, and is solely responsible for all activities carried out under their username and password.

The User understands and agrees to notify the APP immediately of any disclosure or unauthorised use of their username or password, or of any other security breach they become aware of, at the email address info@reciclan.org.

To protect the integrity and security of the Service, RECICLAN APP, S.L. reserves the right, at any time and at its sole discretion, to block certain users' IP addresses from accessing the Service.

6.5 Other matters of interest to the user

  • Management of prizes from partner entities: Prizes provided by partner brands or entities are managed directly by ReciClan, which will handle communication with and assistance to the winners in relation to those prizes.
    Therefore, any query, incident, request for information or claim relating to the delivery, redemption, availability or conditions of enjoyment of these prizes must be addressed to ReciClan, which will take the necessary steps to offer a solution in accordance with the applicable conditions.
  • Free transfer of the prize: In the case of non-personal prizes, the prize will be delivered to the winner, who may dispose of it in accordance with the applicable conditions.
    Where the prize is personal and the winner cannot enjoy it due to duly justified incompatibility or impossibility, they must contact ReciClan, which will assess the circumstances of the case individually and, where possible, propose a suitable alternative or solution, without this necessarily implying a right to the replacement of the prize or financial compensation.
  • Waiver and reassignment: If the winner does not meet the requirements to enjoy the prize and does not wish or is unable to transfer it under the terms provided, they will be deemed to have waived it.
    Waiver entails the loss of the right to the prize, with no right to financial compensation, indemnity, replacement with another prize or refund of any kind. In that case, the prize may be assigned to the next runner-up according to the order established in the ranking or the reassignment rules provided for in the contest rules.
  • Role of the Council: The Council is responsible for organising the contest and defining its rules and general conditions. It is also responsible for establishing the criteria for participation, validating and awarding the official prizes, and resolving claims relating to the general running of the contest, the ranking and the awarding of those official prizes.
  • Role of ReciClan: ReciClan provides technical support for the application, including recording and computing points, as well as producing and updating the participant ranking in accordance with the criteria defined by the Council.
    In addition, ReciClan directly manages the prizes provided by the partner brands and entities incorporated into the application by ReciClan. This management includes, among other actions, communication with the winners, coordination of delivery or redemption, handling of incidents and application of the specific conditions of each prize.

7. Contest rules

The rules governing participation, the running of the contest, the scoring mechanics and the delivery of prizes of the contest organised by each Council through the ReciClan application are set out in full on the Contest rules page, which forms part of these Terms and Conditions of Use.

8. Cookie policy

Cookies used in our App:

The user may withdraw their consent to the use of cookies in the ReciClan application at any time. To do so, the function to exclude cookies must be activated in the account settings section. When this function is activated, the application's cookies will be blocked for that device. Please also note that uninstalling and/or configuring cookies may result in the application not being fully functional.

9. Code of conduct

The User must comply with all applicable laws and use the spaces available in the APP for leaving comments in an appropriate manner, respect the code of conduct set out in this section and bear in mind the liability regime that may arise from the incorrect or unlawful use of these spaces.

ReciClan sets out the conduct it considers inappropriate and the power it has to act accordingly regarding the following uses, actions, omissions or statements by a member, by virtue of their relationship with ReciClan:

  • Acting dishonestly or unprofessionally.
  • Posting inappropriate or inaccurate content.
  • Harassing, abusing, threatening or harming another person or ReciClan member user.
  • Using or posting images, videos or any comment on the profile that may offend Users' sensibilities, or that may discriminate on the basis of any condition, race, ethnic group, nationality, religion, sex, sexual orientation, disability or illness, or that are unlawful, defamatory, abusive, obscene, discriminatory or otherwise objectionable.
  • Using another person's account or creating a false identity in ReciClan.
  • Making false statements that impersonate someone's identity.
  • Including content containing computer viruses or other elements that may delete, interrupt or hinder correct browsing.
  • Selling, sponsoring or obtaining financial gain through ReciClan without the authorisation of RECICLAN APP, S.L., or where another method provided by RECICLAN APP, S.L. has been established for the management of an exclusive service.
  • Sharing information about people who are not Users without their express consent.
  • Creating fake profiles in the application; if ReciClan detects fake profiles, they will be deleted immediately.
  • Promoting racism, xenophobia or bigotry of any kind against any group or individual.
  • Imitating or impersonating any person or entity.
  • Requesting money from other users.
  • Sending videos, audio or photographs containing images of another person without their authorisation (or, in the case of a minor, without the authorisation of their parents or legal guardians).

10. Intellectual property (copyright)

Accessing, browsing and using the ReciClan application (hereinafter, the "APP") does not under any circumstances imply the assignment, transfer, licensing or waiver, in whole or in part, of the intellectual and industrial property rights owned by RECICLAN APP, S.L., nor does it grant the User any exploitation right over them.

All content of the APP, including, by way of example and without limitation, texts, images, designs, logos, distinctive signs, sounds, animations, videos, source code, interfaces, databases and other elements that make it up, is owned by RECICLAN APP, S.L. or, where applicable, RECICLAN APP, S.L. holds the corresponding rights of use and exploitation, and is protected under current regulations, in particular the Spanish Intellectual Property Law.

Licence of use

RECICLAN APP, S.L. grants the User a limited, non-exclusive, non-transferable, revocable and free licence to access and use the APP, strictly within the scope of the features offered and in accordance with these terms of use.

This licence does not grant the User any exploitation right over the content of the APP, and the following is expressly prohibited:

  • Reproducing, copying, distributing, publicly communicating, transforming or modifying the content, in whole or in part.
  • Reverse engineering, decompiling, disassembling or using any technique intended to obtain the source code of the APP.
  • Using the content for commercial, advertising or unlawful purposes.
  • Removing, circumventing or manipulating the protection devices or security systems implemented in the APP.

User's liability

The User undertakes to use the APP in accordance with current legislation, good faith and these conditions, and shall be liable to RECICLAN APP, S.L. and/or third parties for any damages that may arise from the misuse of the APP or from the breach of the provisions set out herein.

In the event of breach, and provided it is so declared by a final court ruling or a decision of the competent administrative authority, the User shall be obliged to compensate RECICLAN APP, S.L. for all damages caused, including liabilities, costs, losses, claims and expenses (including legal fees).

Procedure for reporting infringements

In order to preserve intellectual and industrial property rights, any User or third party who believes their rights have been infringed may report it to RECICLAN APP, S.L. by email at info@reciclan.org, including the following information:

  • Identification details of the holder of the allegedly infringed rights.
  • Where applicable, proof of representation.
  • Specific identification of the allegedly infringing content and its location in the APP.
  • Proof of ownership of the rights invoked.
  • An express statement that the information provided is accurate.

RECICLAN APP, S.L. reserves the right to remove or block content that may infringe third-party rights, without prejudice to any legal action that may apply.

Third-party content

Responsibility for the legitimacy of the intellectual or industrial property rights in content provided by third parties lies exclusively with those third parties, and RECICLAN APP, S.L. is released from any liability arising from it.

11. Updates and amendments

RECICLAN APP, S.L. reserves the right to amend, update, revise or replace the Privacy Policy and the Terms and Conditions of Use of the application (hereinafter, the "Conditions") at any time.

Such amendments will be published through the APP or by the means provided for that purpose, and will apply from the moment of publication. The User's continued access to, browsing of or use of the APP after the amendments come into force will imply express acceptance of the new Conditions.

Waiver of rights

Any failure by either party to exercise a right or power arising from these Conditions shall not constitute a waiver of it, unless such waiver is expressly formalised in writing and duly signed by the party granting it. In any event, waiving a right in a specific case shall not imply a waiver of its exercise in subsequent situations.

Partial invalidity

Should any of the provisions contained in these Conditions be declared null, invalid or unenforceable, in whole or in part, by a final decision of a competent authority, such invalidity shall affect only the provision in question or the affected part of it, and the remaining provisions shall remain in force in all their terms.

Likewise, the affected provision shall be deemed not to have been included to the extent strictly necessary, without affecting its validity in other jurisdictions where it may be fully applicable.

Assignment

RECICLAN APP, S.L. may assign, subrogate, novate or transfer, in whole or in part, the rights and obligations arising from these Conditions to third parties without the User's prior consent, provided that such assignment does not affect the rights granted to the User.

Force majeure

RECICLAN APP, S.L. shall not be liable for any failure or delay in fulfilling the obligations assumed under these Conditions where such failure or delay is the result of force majeure, understood as any unforeseeable event or, even if foreseeable, unavoidable event, including, by way of example and without limitation, labour disputes, strikes, supply failures, interruptions in telecommunications networks, acts of public authorities or any other circumstance beyond the reasonable control of RECICLAN APP, S.L.

12. Arbitration and applicable law

You understand and agree that any dispute or claim arising out of or relating to this Licence Agreement (including any alleged breach of it) or the Service shall be submitted exclusively to the Arbitration Court of Barcelona, Spain, and resolved by binding arbitration in law.

RECICLAN APP, S.L. also reserves the right to bring any civil or criminal action it deems appropriate for the misuse of its App and content or for breach of these conditions.

The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spain. Should any dispute arise, the parties may submit their disputes to arbitration or go to the ordinary courts in accordance with the rules on jurisdiction and competence. RECICLAN APP, S.L. is domiciled in Martorelles (Barcelona), Spain.
